1 MANAGEMENT
The event will be under the management of the ORGANISING COMMITTEE appointed by SOUTH AFRICAN SAILING (SAS) and the ROYAL CAPE YACHT CLUB (RCYC).
2 DEFINITIONS
2.1 "IRC" shall mean the 2002 version of the Royal Ocean Racing Club's IRC handicapping system.
2.2 "CRRS" shall mean the "CAPE - RIO RATING SYSTEM".
2.3 Any reference to the male gender shall include the female gender.
3 COURSE AND DATE
3.1 The event will start in Table Bay and finish off Copacabana Point Rio de Janeiro with Ilha Trindade as a mark of the course to be left to port.
3.2 The event will start on the Saturday 11th January 2003, with slower boats , according to rating, starting on Sat 4th January 2003. The cut-off point for determining which boats will start on which date will be made not later than 30th November 2002.
3.3 Precise details of the start time, start line, the marks to be rounded in Table Bay and the finish line will be published in the Sailing Instructions.
4 TIME LIMIT
4.1 The event will end at 15.00 GMT on Wednesday 5th February 2003 after which all boats that have not finished will be considered to have retired.
4.2 Monitoring the arrival of boats by the Organising Committee and maintaining a radio watch for any boats that have not arrived in Rio de Janeiro will cease with effect from 18.00 GMT on Sunday 9th February 2003.
4.3 The Race Committee reserves the right to extend the time limit under exceptional circumstances.
5 ELIGIBILITY
5.1 The event will comprise of a number of separate fleets so that, as far as possible, only similar boats will race against each other. To that end, there will be separate races for -
5.1.1 mono-hull boats with valid IRC certificates,
5.1.2 multi-hull boats with valid CRRS certificates,
5.1.3 a "rally" fleet of mono-hull and multi-hull boats with valid CRRS certificates which, subject to certain restrictions, will be able to use their motors.
5.1.4 If there is sufficient demand, other classes of boats will, at the Race Committee's sole discretion, be considered.
5.2 Depending on the number of entries, each fleet may be subdivided to ensure fair racing throughout the fleet.
5.3 In addition to the sub-division referred to in clause 5.2, the monohull fleet referred to in clause 5.1.1 shall be further sub-divided between the cruiser/racer fleet and the rest of the fleet for which purpose a cruiser/racer shall mean a boat whose weight in kilograms divided by its rated sail area is greater than 45.
6 RULES
6.1 The event will be governed by the 2001-2004 ISAF Racing Rules of Sailing (RRS), the IRC insofar as this rule applies to competing boats, this Notice of Race, the Sailing Instructions and the Special Regulations contained in Schedule 1.
6.2 In the event of a conflict between any of the above rules and regulations and this Notice of Race and the Sailing Instructions, the provisions of this Notice of Race and the Sailing Instructions will prevail.
6.3 Part 2 of the RRS relating to when boats meet shall only apply for three hours after the first start of the day, after which right of way will be determined by the International Regulations for the Prevention of Collisions at Sea.
7 RATING CERTIFICATES AND HANDICAPS
7.1 Boats shall have current rating and / or handicap certificates as follows -
7.1.1 Boats racing in the IRC fleet referred to in clause 5.1.1 shall have current, valid IRC Certificates.
7.1.2 Boats racing in the other fleets shall have valid CRRS Certificates.
7.1.3 Each boat will be obliged to furnish acceptable proof of its displacement.
7.1.4 The Race Committee reserves the right to request further information regarding measurements of a boat.
7.2 The placing of each boat in its particular fleet shall be determined by the corrected time taken by that boat to complete the course, calculated as follows -
7.2.1 In respect of boats in the IRC fleet, the corrected time will the elapsed time multiplied by the relevant boat's IRC TCC.
7.2.2 In respect of all other boats, the corrected time will be the elapsed time multiplied by the relevant boat's CRRS TCF.
7.3 A list of ratings for each fleet will be published on the Race Notice Board not less than five days prior to the start.
7.4 Valid IRC and CRRS certificates, as the case may be, must be lodged with the Race Secretary no later than 17.00 on Monday 16th December 2002. The Race Committee reserves the right to extend the above time limit in exceptional circumstances.
7.5 On showing good cause and with the prior written approval of the Race Committee, changes may be made to a boat's rating certificate up to four days prior to the boat's start date
7.6 The Race Committee reserves the right to correct, up until the Prize-giving, measurement and calculation mistakes relating to any boat's rating certificates, if notified of these by the South African Sailing Rating Authority.
7.7 Information regarding the obtaining of rating certificates is available from the South African Sailing Office.
8 SAFETY REQUIREMENTS AND SCRUTINY
8.1 Except in the case of the Rally Fleet, each boat shall be crewed by at least 4 persons, including the skipper. The skipper must satisfy the Race Committee by not less than eight days prior to the boat's start time, that at least 2 of those persons are sufficiently qualified to navigate the boat between Cape Town and Rio de Janeiro.
8.2 The Race Committee will be satisfied of a crew members competence if -
8.2.1 he holds a South African Sailing or equivalent Yacht Master Ocean Certificate, or
8.2.2 he holds a South African Sailing or equivalent Yacht Master Offshore Certificate and is able to navigate by celestial observation, or the boat on which he will sail has electronic equipment which complies with paragraph 15 of the Special Regulations and he has completed, as skipper or navigator, offshore races of at least 750 nautical miles or
8.2.3 he holds a South African Sailing or equivalent Coastal Skipper's certificate and is able to navigate by celestial observation, or the boat on which he will sail has electronic navigation equipment which complies with clause 15 of the Special Regulations, and he has completed, as skipper or navigator, an offshore passage of at least 1 000 nautical miles, or
8.2.4 he presents such other evidence of other experience or qualifications as may be acceptable to the Race committee.
8.3 The Race Committee may grant permission for a nominated person to be onboard a boat for a short period after the start of the race for promotional purposes. In this case written permission from the Race Committee must be obtained at least five hours prior to the boat's start. The Notice of Race clause 8.9 regarding crew list requirements and RRS 47.2 will not apply to that person.
8.4 Each boat must, by not less than four days before the boat's start date, have sailed a total of at least 500 nautical miles and the onus shall be on the owner to satisfy the Race Committee thereof.
8.5 All boats shall be scrutinised by the Race Committee to ensure compliance with the safety requirements. The skipper is obliged to ensure that he and at least one other member of the crew are present at the scrutiny.
8.6 A boat which has not passed scrutiny by 24 hours before the boat's start time may not start the event and the onus shall be on the skipper to ensure that his boat is scrutinised timeously.
8.7 If a boat does not comply with these regulations her entry may be rejected or she may be liable to disqualification or such other penalty as may be prescribed by the Race Committee.
8.8 Notwithstanding anything herein contained, the safety of a boat and her crew shall at all times remain the sole responsibility of her skipper, who must satisfy himself that the boat is fully sound, thoroughly seaworthy and manned by an experienced crew who are capable of handling the boat in bad weather. The skipper must ensure that all safety equipment is properly maintained and stowed and that all crew know where it is kept and how it is to be used. It is the sole and exclusive responsibility of each boat to decide whether or not to start or to continue the Race and all those taking part in the Race do so at their own risk.
8.9 The crew list, on the prescribed form provided together with a passport photograph of each crew member, identified by his name on the reverse side, shall be submitted to the Race Secretary not less than four days before the boat's start date. Contingency corrections to this crew list, complying with the photograph requirement, may be made up to four hours before the start of the event.
9 ENTRIES
9.1 An entry, on the prescribed entry form, must be submitted with the relevant entry fee to the Race Secretary, PO Box 479, GREEN POINT, 8051, South Africa by not later than 17.00 on Monday 7th October 2002. Late entries will be accepted up to 17.00 on Monday 9th December 2002, subject to an increased entry fee.
9.2 The entry fee shall be R2000 provided that in the case of a late entry the fee shall be R2 500.
9.3 Each entry must be accompanied by a brief biographical note of the owner and/or skipper which may include information on the crew and, if possible, should include photographs of the owner and/or skipper and of the boat. The Organising Committee shall be and is hereby authorised to use such biographical information and photographs in connection with any advertising, publication, promotion, sponsorship or the like relating to the race whether in printed or electronic form or howsoever.
9.4 The Race Committee reserves the right to refuse any entry or to exclude any boat from the event at it's sole discretion.
10 MOORINGS
Save in exceptional circumstances, every competing boat shall be required to moor at RCYC for the 10 days immediately preceding its start or from the time of its arrival in Cape Town, whichever is the shorter period, unless exempted by the Organising Committee from doing so for good reason such as draft limitation. Applications for exemption must be submitted to the Race Secretary at the time of submission of the boat's entry.
11 ADVERTISING AND REFERENCE TO RACE
11.1 Advertising will be permitted in accordance with the ISAF Advertising Code (Appendix 1 - Regulation 20), for which purpose the event shall be classified as a Category "C" event.
11.2 Any reference of any nature to the race, at any time, on clothing or in advertising or wherever, shall include the name of the sponsor coupled to the words "Cape to Rio" and the provisions of this clause shall apply from the time of entry until the Prize Giving,
11.3 The name of any boat, whether displaying advertising or not, must be acceptable to the Race Committee. No entry will be accepted from a boat displaying advertising or having a name which conflicts with any interests of the race sponsor, or any sub-sponsor of the event.
11.4 The owner and skipper of all boats participating in the event shall ensure that nothing is done by them or any of their crew or promoters or agents which will, or is reasonably likely to, injure, bring into disrepute, ridicule or lessen the public reputation, goodwill or favourable image of the event, the organisers and the event sponsors.
11.5 Participants in the event shall supply the organisers with a copy of all press releases and all promotional material issued by or on behalf of themselves or their sponsors relating to the event.
11.6 The owner and skipper of all boats shall ensure that no "ambush marketing" or "hijack signage" is carried out by or on behalf of themselves or their sponsors with reference to the event and that nothing else is done which might undermine the event, the rights of the event sponsor, or any other sponsor or participant in the event.
11.7 The organisers and sponsors shall be entitled to make use of any photograph, film or other form of electronic reproduction of or relating to all boats participating in the event, their owners and crew and to make use of all interviews, broadcasts and reports by any of them for any purpose relating to or arising from the event or the sponsorship thereof.
11.8 The skipper of a boat, if and when requested to do so, shall from time to time provide the organisers with a written or verbal report of the boat's current position or any other matter of interest, suitable for use on the radio, television and internet.
11.9 The entry of a boat breaching any of the provisions of this clause 11 may be rejected and any boat breaching any of these provisions shall be subject to disqualification or such penalty to her corrected time as the Race Committee my deem fit.
12 SAILING INSTRUCTIONS
Sailing Instructions will be issued to all entrants prior to the start of the Race.
13 INFRINGEMENTS
If a boat infringes any of the provisions of this Notice of Race or of the Sailing Instructions or any of the Rules and Regulations herein referred to, in circumstances which in the opinion of the Race Committee do not constitute a gross breach thereof, it may be penalised by having it's basic elapsed time increased by such amount as the Race Committee, in it's sole discretion, deems fit. In addition, the Race Committee shall be entitled to disqualify a boat in the event of a gross breach of any of such provisions, rules or regulations. Any penalty imposed by the Race Committee pursuant to this provision will not be subject to appeal.
14 PRIZE-GIVING
14.1 The Prize Giving will take place at the Iate Clube do Rio de Janeiro on a date to be published.
14.2 Trophies and Prizes to be awarded in the various fleets and Divisions will be published at a later date.
14.3 The skipper and at least one other member of the crew of a boat due to receive a prize will be obliged the attend the Prize Giving. If, for good reason, this is not possible, the owner and skipper undertake to inform the Organising Committee prior to the Prize Giving.
15 INDEMNITY
The owner and the skipper of each boat entered shall be deemed, on the acceptance of the entry by the Race Committee, on behalf of themselves, their crew, their dependants and their sponsors to have indemnified the Organisers, the sponsors and all those involved in the running of the event against all claims of any kind arising from any injury to person or property incurred during or in connection with the event, or from any other cause arising whatsoever. Owners and skippers are advised to obtain counter-indemnities from each member of the crews.
16 JURISDICTION
The event, being organised from Cape Town, is subject to the laws of South Africa and accordingly this Notice of Race and the Sailing Instructions will be construed in accordance with such laws. All participants, owners, skippers and crews shall be deemed to have submitted to the jurisdiction of the High Court of South Africa, Cape Town, which alone shall have jurisdiction in regard to any legal disputes which may arise in connection with or arising from the event and a participant's participation therein. Owners and skippers of boats participating in the event will be responsible for ensuring that the provisions of this Notice of Race are understood and agreed by all individuals concerned and hereby indemnify the organisers, the sponsors and all those involved in the running of the event against all claims, loss or harm suffered as a result of a failure to do so.
17 ERRORS AND OMISSIONS
On good cause, the Organising Committee reserves the right to amend any of the provisions of this Notice of Race.
